This Privacy Policy (the “Policy”) applies to Experience It Inc.’s (“SHORT NAME”, “We”, “Us” or “Our”) customers in Canada, visitors to Our website or any other digital distribution service or mobile application on which We provide this Policy, and users of Our learning simulation and coaching Apps (collectively, the “Services”). This Policy describes how and why We collect Personal Information in the course of providing the Service, and how that data will be used and shared with third parties. We may collect the following Personal Information when you contact Us, register with Us, use Our Services or otherwise provide Us with information about you:

  • contact information, such as your work email address, zip/postal code and country;
  • education level;
  • work information, including but not limited to job title, function and length in leadership roles;
  • preferred name/username for our Services or third party services that you have linked to our services;
  • information you may submit to Us voluntarily during your use of the Services and/or communications with Us;
  • information generated in the course of your use of the Services, including your responses to learning-based questions posed in the Apps, and your score/evaluation;
  • information provided to us by third party advertising and analytics companies (see “Cookies and Tracking Technologies”;
  • information about you that may be provided to Us by third parties where they have your consent to do so or where otherwise permitted by law.

The following usage information may be collected automatically by us or our third party services providers through your web browser or device:

  • information about your web browser, to allow us to provide you with the correct version of our Apps to download;
  • information about how, when and where you use Our Services;
  • the hardware and software you use to interact with Our Services;
  • your device identifier;
  • your mobile network information;
  • the settings you use on Our Services;
  • your network location;
  • your IP address; and
  • information about the webpages you visited prior to coming to Our website.

We may use your Personal Information for the following purposes:

  • provide you with Our Services;
  • complete transactions and process payment;
  • provide you with support and handle inquiries;
  • to communicate with you about Our Services, including by sending your electronic marketing materials where permitted by applicable laws;
  • improve the quality and functionality of Our website and Apps, enhance your experience, create new services (including customized services), change/cancel existing content and services, or for sales and marketing analytics and statistical purposes;
  • ensure that Our website and Apps remain functioning and secure;
  • investigate, prevent or act on any illegal activities or violations of Our Terms of Use and/or the End User License Agreement;
  • generate anonymized or aggregated data which We may use and disclose for Our business purposes in our sole discretion; and
  • comply with any applicable law and assist law enforcement agencies as required. 

We may share your Personal Information with the following parties:

  • Our trusted third party service providers, including cloud service providers, payment providers, customer relationship management service providers, and other service providers such as individuals or organizations who are, or may be, involved in maintaining, reviewing and developing Our systems, procedures and infrastructure including testing or upgrading of Our systems, who in turn use the information strictly in accordance with Our instructions and applicable law;
  • analytics service providers as disclosed in Our full Privacy Policy.

Depending on Your use of Our Services, your choices may include the following:

  • Access and Correction: You can access your Personal Information and ask Us to update, correct or delete any information We have about you.
  • Cookies and tracking technologies: You may disable cookies and other tracking technologies through the settings in your browser and by opting-out using the instructions provided in this Privacy Policy. While doing so may negatively impact your experience using the Services, as some features of the Services may not work properly, disabling cookies will not prevent you from transacting with us.

In case of a breach of security safeguards, We will:

  • notify you, the Office of the Privacy Commissioner of Canada and/or any provincial Information and Privacy Commissioner(s), as appropriate;
  • notify any other organization or government institution that can reduce the risk or mitigate the harm from the breach; and

1. What is Personal Information?

“Personal Information” means any information about an identified individual or an individual whose identity may be inferred or determined from such information. “Personal Information” may or may not include business contact information, depending on the jurisdiction.

 

 2. What Personal Information do We collect?

We may collect the following Personal Information when you contact us, register with us, use our services or otherwise provide us with information about you:

  • full name;
  • contact information, such as your work email address, zip/postal code and country;
  • education level;
  • work information, including but not limited to job title, function and length in leadership roles
  • preferred name/username for our Services or third party services that you have linked to our services;

Automatically Collected User Information

We obtain certain information about your use of Our website including via our third party service providers. This information is collected when publishers, advertisers, and ad networks use the Experience It Inc. platform. Additionally, certain other information (such as cookies, described below) may be transmitted by our Web server to your computer. Specific types of usage information that may be collected automatically are described below:

  • information about your web browser, to allow us to provide you with the correct version of our Apps to download;
  • information about how, when and where you use Our Services;
  • the hardware and software you use to interact with Our Services;
  • your device identifier;
  • your mobile network information;
  • the settings you use on Our services;
  • your network location;
  • your IP address; and
  • information about the webpages you visited prior to coming to our website.

 

3. How do We collect your Personal Information?

We only collect Personal Information for purposes that would be considered reasonable in the circumstances and only such information as is required for the purposes of providing Our Services. We use only fair and lawful methods to collect Personal Information. We may collect your name and email address from your employer in order to contact you about our Services.

(i)        Consent

Unless permitted by law, no Personal Information is collected, without first obtaining the consent of the individual concerned to the collection, use and disclosure of that information. By using Our Services, or otherwise interacting with Us, you consent to the collection, use and disclosure of your Personal Information by Experience It Inc. in accordance with the terms of, and for the purposes set out in, the Privacy Policy. However, We may seek consent to use and disclose Personal Information after it has been collected in those cases where We wish to use the information for a new or different purpose where the individual concerned has not already consented to such a use of their personal information.

 

We may also seek your express (“opt-in”) consent where We consider your Personal Information to be of a sensitive nature. For example, you may be given the option to provide Us your consent to share your responses given within learning simulations with other users (in circumstances where these responses may be identified with you), or to share your scoring results with other users.

(ii)       Withdrawing your consent

In most cases and subject to legal and contractual restrictions, you are free to refuse or withdraw your consent at any time upon reasonable, advance notice. Your withdrawal of consent will not operate retroactively. It should be noted that in certain circumstances, Our Services can only be offered if you provide Us with your Personal Information. Consequently, if you choose not provide Us with the required Personal Information, we may not be able to offer you certain Services. We will inform you of the consequences of the withdrawal of consent.

 

4. Cookies and tracking technologies

Cookies

We use Cookies to collect usage information when you visit Our website and for our analytics and marketing purposes.. Cookies are small text files placed on your hard drive that assist Us in providing a more customized website experience and that provide us with information about your usage of our website and electronic communications that we send to you. We use the following third party service providers to provide us with analytics and marketing information:

i. Mailchimp: User email campaigns

Mailchimp places single pixel gifs, also known as web beacons, in emails that are sent by Us. These are tiny graphic files that contain unique identifiers that enable Us to recognize when you have opened an email or clicked certain links. These technologies record your email address,

IP address, date, and time associated with each open and click.. Mailchimp uses this data to create reports for Us about how an email campaign performed and the actions taken by the recipients of Our emails.

ii. LinkedIn Website Demographics

The LinkedIn Insight Tag is a piece of lightweight JavaScript code that We have added to Our website to enable in-depth campaign reporting and to help us unlock valuable insights about our website visitors. We use the LinkedIn Insight Tag to track conversions, retarget website visitors, and unlock additional insights about members interacting with our LinkedIn adverts. The LinkedIn Insight Tag enables the collection of metadata such as IP address information, timestamp, and events such as page views. All data is encrypted. The LinkedIn browser cookie is stored in a visitor’s browser until they delete the cookie or the cookie expires.

iii. Google Analytics:

Google Analytics cookies store information in order to report on website trends. The information collected includes the pages a visitor visits, the time a visit occurred, whether the visitor has been to the site before and what site referred the visitor to the web page. The cookies report website trends; they do not identify individual visitors and visitors cannot be tracked across multiple sites.

Our use of Personal Information is limited to the purposes described in this Policy. We do not otherwise sell, trade, barter, exchange or disclose for consideration any Personal Information we have obtained.

 

6. How do we share your Personal Information?

Experience It Inc. may transfer or disclose the data collected from customers, users of the Apps and website visitors, including Personal Information, to the following parties:

  • other participants and users of Our learning and simulation coaching Apps without identifying you, except where you voluntarily choose to share your answers (in circumstances where they may identify you) or where you choose to participate in a “Leaderboard” that displays the scores of individual during a learning simulation. Please note that if a learning cohort is sufficiently small, there is a risk that other App users within your organization could approximate your score obtained when using our learning simulation Apps(s);
  • Our trusted third party service providers, including cloud service providers, payment providers, customer relationship management providers, and other service providers such as individuals or organizations who are, or may be, involved in maintaining, reviewing and developing Our systems, procedures and infrastructure including testing or upgrading of Our systems, who in turn use the information strictly in accordance with Our instructions and applicable law;
  • In the context of a business transaction, We reserve the right to transfer any Personal Information We have in the event that We merge or are acquired by a third party or should a third party acquire all or part of our business or should any such transaction be proposed, in accordance with applicable laws.

 

7. How long do We retain your Personal Information?

We keep your Personal Information only as long as it is required for the reasons it was collected.  The length of time We retain your Personal Information varies, depending on the purpose for which it was collected and the nature of the information. This period may extend beyond the end of your relationship with us but it will be only for so long as it is necessary for us to have sufficient information to respond to any issues that may arise at a later date. As such, We may keep your account information after the termination of your account. When your Personal Information is no longer required for the purposes for which it was collected, we will destroy, delete, erase or convert it into an anonymous form. If We learn that we have unintentionally stored personal information (e.g., if We become aware that a URL that we store contains personal information), We will use commercially reasonable efforts to anonymize or purge this information.

 

8. Where do We store your Personal Information? 

Your personal information is stored by Us on a single tenant server located in Tampa, Florida, USA. Experience It Inc. also may transfer personal information to service providers whom are located outside of Canada, where privacy laws may offer different levels of protection from those in Canada. When transferred or stored outside of Canada, or transferred to a service provider outside of Canada, your Personal Information may be subject to access by and disclosure to law enforcement agencies under the applicable foreign legislation. Upon request, We will provide you with information on the jurisdictions in which our service providers store your Personal Information.

  

9. How do we protect your Personal Information?

Information that We collect is stored on a single server that Experience It Inc. solely manages, using industry standard physical, technical and organizational security procedures and practices appropriate to the nature of the information, in an effort to protect information from unauthorized access, destruction, use, modification, or disclosure. We further protect your Personal Information by restricting access to it to those employees that require access to the information in order to provide Our Services. We caution that, while we endeavor to secure your Personal Information, no network or server is 100% secure.

 

10. What do we do in case of a privacy or security breach?

 A “breach of security safeguards” is defined as the loss of, unauthorized access to or unauthorized disclosure of personal information resulting from a breach of an organization’s security safeguards or from a failure to establish those safeguards. In case of a breach of security safeguards involving your Personal Information under our control, we will notify you and the Privacy Commissioner of Canada, and any provincial Information and Privacy Commissioner(s), as appropriate, if it is reasonable in the circumstances to believe that the breach creates a real risk of significant harm to you, including physical, financial or reputational harm. We will also notify any other organization or government institution that can reduce the risk or mitigate the harm from the breach. We will keep a record of all breaches in accordance with our legal obligations.

 11. How can you access or correct any inaccuracies in your Personal Information?

Experience It Inc. endeavors to ensure that any Personal Information provided and in Our possession is as accurate, current and complete as necessary for the purposes for which We use that information. If We become aware that Personal Information is inaccurate, incomplete or out of date, we will endeavor to correct such inaccuracy.

Experience It Inc. permits the reasonable right of access to and review of Personal Information held by Us about an individual and will endeavour to provide the information in question within a reasonable time in accordance with applicable law, generally no later than 30 days following the request. To guard against fraudulent requests for access, We may require sufficient information to allow Us to confirm that the person making the request is authorized to do so before granting access or making corrections. Your access to and review of Personal Information may be limited or restricted to protect Our confidential business information, solicitor-client privileged information, or the Personal Information of other individuals, as permitted or required by applicable laws.

Experience It Inc. has no control over such third-party websites and resources, and you acknowledge and agree that Experience It Inc. is not responsible for the content or information contained therein. When you follow such a link, you are no longer subject to Our Privacy Policy, and we encourage you to read the privacy statements or other disclaimers of such other parties. Experience It Inc. is not responsible for the privacy or security practices or the content of external websites, services or products.

Experience It Inc. cannot and does not guarantee, represent or warrant that the content or information contained in such third-party websites and resources is accurate, legal, non-infringing or inoffensive. Experience It Inc. does not endorse the content or information of any third-party website or resource and, further, Experience It Inc. does not warrant that such websites or resources will not contain viruses or other malicious code or will not otherwise affect your computer.
